Disagree on strategy, but never on character.<\/li>\n\n\n\n<li><strong>Operational Discipline (Forum Integrity):<\/strong> Keep the site clean. Post your intel in the correct department (forum). This ensures the library remains searchable and efficient for everyone.<\/li>\n\n\n\n<li><strong>The Unit Over the Individual (Helpfulness):<\/strong> This is a collective intelligence network. If you see a brother-in-arms struggling with a problem you\u2019ve already solved, provide the answer. We grow faster as a Battalion than as isolated mercenaries.<\/li>\n\n\n\n<li><strong>The No-Whine Protocol (Solution-Focus):<\/strong> Identifying a problem is only half the job. Whining without a proposed solution is prohibited. If you post a bottleneck, you must either offer a potential fix or ask for a specific system to address it.<\/li>\n\n\n\n<li><strong>Operational Security (OPSEC):<\/strong> What happens in the Battalion stays in the Battalion. All PDFs, blueprints, videos, and private squad discussions are Proprietary Intel. Leaking this material devalues the investment of every other member.<\/li>\n\n\n\n<li><strong>No Mercenaries (Solicitation):<\/strong> You are here to build your electrical business, not to hunt for customers among the membership. Pitching your own coaching or products to other members is forbidden unless authorized.<\/li>\n\n\n\n<li><strong>Chain of Command (Moderation):<\/strong> Moderators and Squad Leads keep the machine running. Their decisions on post placement and conduct are final. Grievances should be handled privately with the Architect.<\/li>\n\n\n\n<li><strong>Radical Ownership (Accountability):<\/strong> The Iron Academy provides the blueprints; you provide the labor. You are 100% responsible for the implementation of these systems and the results in your business.<\/li>\n\n\n\n<li><strong>The Code Standard (Trade Integrity):<\/strong> We never compromise on trade safety. Advice that encourages illegal work, &#8220;hacking&#8221; the code, or compromising safety standards is not tolerated.<\/li>\n\n\n\n<li><strong>Collective Momentum (Engagement):<\/strong> Engagement is strongly encouraged. To get the most out of the Academy, everyone should participate in discussions. This provides value not just to the group, but also to you. Active members solve bottlenecks faster and see a higher return on their investment.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\ud83d\udee1\ufe0fPrivacy Policy<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Elevated Velocity Electrical Consulting, LLC (EVEC)<\/strong>&nbsp;respects your privacy. We collect names, emails, and shipping addresses solely for the purpose of order fulfillment and Academy communications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment data is processed securely via&nbsp;<strong>Stripe<\/strong>; EVEC does not store your credit card information. We do not sell or share your data with third parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>\ud83d\udee1\ufe0f<\/strong>Terms of service<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 1: DEFINITIONS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In this Agreement, the following terms shall have the specific meanings assigned to them below. These definitions apply across the Terms of Service, Privacy Policy, and User License Agreement.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>&#8220;The Company&#8221;:<\/strong> Refers to Elevated Velocity Electrical Consulting, LLC (EVEC), the legal entity owning and operating the Academy.<\/li>\n\n\n\n<li><strong>&#8220;The Architect&#8221;:<\/strong> Refers specifically to Liam F. McCusker, the founder and creator of the proprietary intellectual property contained herein.<\/li>\n\n\n\n<li><strong>&#8220;The Academy&#8221;:<\/strong> Refers to The Iron Academy, the private membership community and educational platform provided by the Company.<\/li>\n\n\n\n<li><strong>&#8220;Operational Doctrine&#8221;:<\/strong> (Also referred to as <strong>&#8220;The Doctrine&#8221;<\/strong> or <strong>&#8220;Succession Engine Doctrine&#8221;<\/strong>) Refers to the proprietary business framework, blueprints, and schematics developed by Liam F. McCusker for the scaling of electrical contracting businesses.<\/li>\n\n\n\n<li><strong>&#8220;The Battalion Hub&#8221;:<\/strong> Refers to the digital infrastructure and platform where members access Academy content and community features.<\/li>\n\n\n\n<li><strong>&#8220;Training Vault&#8221;:<\/strong> Refers to the digital repository containing all exclusive video modules, standardized worksheets, and downloadable blueprints which constitute the Company&#8217;s Trade Secrets.<\/li>\n\n\n\n<li><strong>&#8220;Rank&#8221;:<\/strong> Refers to the tiered membership levels (Recruit, Battalion, or Commander) which govern the Member\u2019s level of intelligence access and coaching.<\/li>\n\n\n\n<li><strong>&#8220;Squad&#8221;:<\/strong> Refers to the private peer-to-peer accountability groups where business data and strategic intelligence are shared among members.<\/li>\n\n\n\n<li><strong>&#8220;The Articles of Engagement&#8221;:<\/strong> Refers to the mandatory Community Code of Conduct that governs all interactions within the Academy and The Battalion Hub.<\/li>\n\n\n\n<li><strong>&#8220;Conduct Unbecoming&#8221;:<\/strong> Refers to any violation of the Articles of Engagement\u2014including but not limited to ego-wars, unauthorized solicitation, or IP theft\u2014which constitutes a material breach of this contract.<\/li>\n\n\n\n<li><strong>&#8220;Trade Secrets&#8221;:<\/strong> Includes all downloadable PDFs, proprietary math formulas, internal blueprints, and video transcripts that are not available to the general public and are protected under relevant intellectual property laws.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 2: THE EDUCATIONAL SHIELD (DISCLAIMER OF LIABILITY)<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.1 Educational Framework Only.<\/strong> The Member acknowledges that The Iron Academy and all materials contained within the Company\u2019s platforms are provided for educational and informational purposes only. The Company is not engaged in rendering professional engineering, legal, financial, or safety services. The Architect is providing strategic frameworks based on historical experience, not a professional certification or a guarantee of specific business outcomes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.2 No Professional-Client Relationship.<\/strong> Use of the Battalion Hub, participation in Squads, or attendance at Tactical Coaching Calls does not create a professional-client relationship (such as an Engineer-of-Record, Attorney-Client, or CPA-Client relationship) between the Member and the Company or the Architect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.3 Technical and Compliance Disclaimer.<\/strong> The Company does not provide technical, trade, or regulatory compliance services. Any frameworks, schematics, or benchmarks provided within the Academy are for illustrative purposes only. The Member is solely responsible for ensuring that all work, scaling strategies, or operational changes comply with all applicable local, state, and federal laws, building codes, and industry standards. Because regulatory requirements and legal standards vary significantly by jurisdiction, the Member assumes all responsibility for verifying compliance with the specific laws governing their local area of operation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.4 Financial and Legal Risk.<\/strong> Business scaling involves inherent financial risk. The Company is not responsible for any financial losses, labor disputes, wrongful termination claims, or tax liabilities incurred by the Member while attempting to implement the material contained within the Academy. The Member is advised to consult with their own legal and financial professionals before making structural changes to their business or employment contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.5 Implementation at Sole Risk.<\/strong> The Member assumes 100% responsibility for the results of their actions. The Company, its employees, and the Architect shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the material contained within the Academy, including but not limited to business interruption, loss of profits, or physical injury occurring on a job site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.6 Indemnification.<\/strong> The Member agrees to indemnify, defend, and hold harmless The Company and The Architect from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney\u2019s fees) arising from the Member&#8217;s implementation of the Academy&#8217;s materials or any breach of these Terms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 3: INTELLECTUAL PROPERTY &amp; THE TRAINING VAULT (THE IP FORTRESS)<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.1 Ownership of Intellectual Property.<\/strong> The Member acknowledges and agrees that <strong>The Architect<\/strong> is the sole and exclusive owner of all right, title, and interest in and to the <strong>Operational Doctrine<\/strong>, including all copyrights, trademarks, patents, trade secrets, and other intellectual property rights. Nothing in this Agreement shall be construed as a transfer of ownership of any intellectual property from <strong>The Company<\/strong> or <strong>The Architect<\/strong> to the Member.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.2 The Training Vault as Trade Secrets.<\/strong> All materials contained within the <strong>Training Vault<\/strong>, including but not limited to video modules, downloadable blueprints, standardized worksheets, proprietary formulas, and strategic schematics, are classified as <strong>Trade Secrets<\/strong>. This information is not known to the general public and derives independent economic value from being kept confidential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.3 Limited, Non-Exclusive License.<\/strong> Upon payment of the applicable fees, the Member is granted a limited, non-exclusive, non-transferable, and revocable license to access the material contained within the Academy for their internal business use only. This license is granted to one (1) individual user per membership and may not be shared, assigned, or sublicensed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.4 Prohibited Actions (Zero Tolerance).<\/strong> The Member is strictly prohibited from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Recording:<\/strong> Screen-recording, capturing, or otherwise duplicating video content from the Battalion Hub.<\/li>\n\n\n\n<li><strong>Redistribution:<\/strong> Sharing, selling, or &#8220;leaking&#8221; any PDF downloads, blueprints, or login credentials to third parties or non-members.<\/li>\n\n\n\n<li><strong>Reverse Engineering:<\/strong> Attempting to deconstruct or recreate the proprietary frameworks for the purpose of creating a competing educational or consulting product.<\/li>\n\n\n\n<li><strong>Public Disclosure:<\/strong> Discussing the specific, granular details of the Doctrine in public forums, social media, or other external environments.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.5 Breach and Devaluation.<\/strong> The Member acknowledges that any unauthorized sharing or &#8220;leaking&#8221; of Academy material fundamentally devalues the community and the investment made by all other members. Any breach of this Section shall be considered <strong>Conduct Unbecoming<\/strong> and a material breach of contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.6 Enforcement and Remedies.<\/strong> In the event of a suspected breach of IP security, <strong>The Company<\/strong> reserves the right to:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Immediately terminate the Member\u2019s access to the Academy without refund.<\/li>\n\n\n\n<li>Seek permanent injunctive relief to prevent further disclosure.<\/li>\n\n\n\n<li>Pursue statutory damages and legal fees in the jurisdiction of Hampden County, Massachusetts.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 4: MEMBER-TO-MEMBER LIABILITY &amp; SQUAD OPERATIONS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.1 Nature of Peer-to-Peer Interaction.<\/strong> The Member acknowledges that the Academy utilizes <strong>Squads<\/strong> and forum-based &#8220;Muster&#8221; groups to facilitate accountability and strategic growth. These environments involve the voluntary exchange of business data, operational intelligence, and strategic challenges between Members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.2 Assumption of Risk for Voluntary Disclosure.<\/strong> Participation in any Squad or community discussion is strictly voluntary. <strong>The Company<\/strong> does not mandate the disclosure of trade secrets, sensitive financial data, or proprietary client lists belonging to the Member\u2019s business. If the Member chooses to share such information within a Squad or to another Member, they do so at their own sole risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.3 Disclaimer of Confidentiality Between Members.<\/strong> While the <strong>Articles of Engagement<\/strong> encourage a culture of &#8220;What happens in the Battalion stays in the Battalion,&#8221; <strong>The Company<\/strong> and <strong>The Architect<\/strong> cannot and do not guarantee the security or confidentiality of information shared between Members. <strong>The Company<\/strong> is not liable for any &#8220;leaks,&#8221; misappropriation of data, or breach of trust committed by one Member against another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.4 Member-to-Member Non-Disclosure Agreements (NDAs).<\/strong> If a Member chooses to share sensitive company intelligence, internal financials, or proprietary processes with another Member (e.g., during a deep-dive audit or peer-coaching session), the Member is solely responsible for executing their own independent Non-Disclosure Agreements or legal protections. <strong>The Company<\/strong> will not provide, mediate, or enforce legal agreements between individual Members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.5 No Agency or Partnership.<\/strong> Interaction within a Squad does not create a partnership, joint venture, or agency relationship between Members, nor between any Member and <strong>The Company<\/strong>. No Member has the authority to bind another Member or <strong>The Company<\/strong> to any legal or financial obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.6 Reporting Misconduct.<\/strong> While <strong>The Company<\/strong> is not responsible for Member-to-Member data breaches, any Member discovered using information gained within a Squad to actively harm, compete with, or solicit the clients of another Member will be cited for <strong>Conduct Unbecoming<\/strong> and subject to immediate termination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.7 Classified Intelligence.<\/strong> The Member acknowledges that higher-tier Ranks (Battalion and Commander) grant access to &#8220;Classified Intelligence,&#8221; which includes the internal business metrics, personal struggles, and proprietary strategies of other Members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.8 The Code of Silence.<\/strong> There is no &#8220;implied&#8221; confidentiality; there is only an absolute mandate. The Member agrees that all information shared within a Squad or during Tactical Coaching Calls is strictly confidential.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>No External Briefings:<\/strong> The Member shall not discuss, summarize, or &#8220;vague-post&#8221; about the specific business challenges or data of another Member on social media, public forums, or with non-members.<\/li>\n\n\n\n<li><strong>No &#8220;Cross-Pollination&#8221;:<\/strong> Intelligence shared in a specific Squad stays in that specific Squad. It is not to be shared with Members of other Squads or lower Ranks.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4.9 Enforcement of the Covenant.<\/strong> A breach of this Code of Silence is a betrayal of the Battalion\u2019s integrity. Any Member found to be &#8220;leaking&#8221; or gossiping about the internal operations of another Member will be cited for <strong>Conduct Unbecoming<\/strong> and will face immediate, permanent removal from the Academy with no recourse for refund. <strong>The Company<\/strong> reserves the right to facilitate the exchange of Member identity information to the aggrieved party should they choose to pursue private legal action for breach of confidentiality.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 5: SUBSCRIPTION, FINANCIAL TERMS, &amp; THE &#8220;NO REFUND&#8221; POLICY<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.1 Founding Contributions.<\/strong> For those participating in the initial pre-order phase (including &#8220;Founding 10&#8221; members), the payment is categorized as a &#8220;One-Time Founding Contribution.&#8221;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fixed Term Access:<\/strong> This contribution grants the Member access for the specific duration identified in their chosen pre-order tier.<\/li>\n\n\n\n<li><strong>No Automatic Renewal:<\/strong> Access for Founding 10 members is <strong>not<\/strong> set for automatic renewal. Upon the expiration of the term identified in the pre-order, access to the Battalion Hub and Training Vault will cease unless the Member explicitly chooses to transition to a recurring subscription.<\/li>\n\n\n\n<li><strong>Non-Refundable:<\/strong> These contributions are fully earned by <strong>The Company<\/strong> upon the grant of access to the digital preliminary materials and are non-refundable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.2 Founding 10 Transition to Subscription.<\/strong> At the conclusion of the Founding Member\u2019s initial term, <strong>The Company<\/strong> will provide the Member with options to continue their membership via a recurring subscription. No credit card charges or automatic renewals will occur for Founding 10 members unless and until a new Subscription Agreement is explicitly entered into by the Member.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.3 Standard Subscription Tiers (Post-Launch).<\/strong> For members joining after the launch phase, or Founding members who have explicitly opted-in to a recurring plan, access is governed by a subscription model based on the Member\u2019s chosen <strong>Rank<\/strong>. The Member\u2019s payment method on file will be automatically debited each month on the anniversary of their sign-up or opt-in date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.4 Third-Party Payment Processing (Stripe).<\/strong> Payment processing services for the Academy are provided by <strong>Stripe, Inc.<\/strong> (&#8220;Stripe&#8221;).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>No Storage of Financial Data:<\/strong> <strong>The Company<\/strong> does not store, see, or have access to your full credit card numbers, CVV codes, or bank account details. All payment data is handled directly by Stripe.<\/li>\n\n\n\n<li><strong>Agreement to Stripe Terms:<\/strong> By choosing to purchase a membership, the Member agrees to be bound by the Stripe Services Agreement and relevant payment terms.<\/li>\n\n\n\n<li><strong>Liability Limitation:<\/strong> <strong>The Company<\/strong> is not responsible for any errors, processing delays, or security breaches occurring within Stripe\u2019s infrastructure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.5 Strict &#8220;No Refund&#8221; Policy.<\/strong> Due to the digital nature of the material contained within the Academy and the immediate access granted to <strong>Trade Secrets<\/strong> and the <strong>Training Vault<\/strong> upon registration, <strong>The Company<\/strong> maintains a strict <strong>No Refund Policy<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Instant Value:<\/strong> The Member acknowledges that the value of the Academy is delivered immediately upon access to the proprietary frameworks.<\/li>\n\n\n\n<li><strong>No Exceptions:<\/strong> Refunds will not be issued based on a Member\u2019s failure to implement the material, dissatisfaction with business results, or personal financial changes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.6 Termination for Breach.<\/strong> If a Member is terminated for <strong>Conduct Unbecoming<\/strong>, IP theft, or a breach of the <strong>Covenant of Silence<\/strong>, their access will be revoked immediately. In such cases, the Member forfeits all remaining time on their term or subscription and is not entitled to a refund of any kind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.7 Physical Goods &amp; Shipping.<\/strong> * <strong>Founding 10 Promotional Items:<\/strong> For the initial &#8220;Founding 10&#8221; members only, <strong>The Company<\/strong> will facilitate the shipping of the commemorative physical hardcover book within the United States. <strong>The Company<\/strong> is not responsible for items once they have been transferred to the shipping carrier.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Third-Party Distribution:<\/strong> For all other members and for any purchases of physical materials made outside of the initial Founding 10 promotion, fulfillment and shipping are handled exclusively by third-party distributors (e.g., Amazon, etc.). <strong>The Company<\/strong> assumes no liability for shipping delays, lost packages, or damages occurring during the fulfillment process by these third-party entities. The Member must resolve shipping issues directly with the respective distributor.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 6: CONDUCT UNBECOMING &amp; TERMINATION (ENFORCEMENT)<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.1 The Articles of Engagement.<\/strong> Access to the Academy is a privilege, not a right. By entering the Battalion Hub, the Member agrees to abide by the Articles of Engagement, which serve as the professional and operational standard for the community.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.2 Definition of Conduct Unbecoming.<\/strong> The Company reserves the right to terminate any Member\u2019s access, without refund, for &#8220;Conduct Unbecoming.&#8221; This is defined as any action that sabotages the community culture, disrupts operational discipline, or violates the proprietary nature of the material contained within the Academy. Specific violations include, but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ego-Wars:<\/strong> Engaging in personal attacks, insults, or professional grandstanding within the forums or Squads.<\/li>\n\n\n\n<li><strong>Whining Without Solutions:<\/strong> Identifying bottlenecks or problems without offering a potential fix or making a specific request for a system to address it.<\/li>\n\n\n\n<li><strong>Solicitation (No Mercenaries):<\/strong> Using the Academy to hunt for customers, pitch unauthorized products\/coaching, or &#8220;poach&#8221; employees from other members.<\/li>\n\n\n\n<li><strong>Radical Ownership Failure:<\/strong> Repeatedly failing to accept 100% responsibility for the implementation of systems and the results within the Member\u2019s own business.<\/li>\n\n\n\n<li><strong>Code Sabotage:<\/strong> Encouraging or detailing advice that involves illegal work, bypassing local code, or compromising trade safety standards.<\/li>\n\n\n\n<li><strong>Operational Discipline Failure:<\/strong> Repeatedly failing to keep the digital infrastructure clean by posting intelligence in incorrect departments or forums.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.3 Authority and Process.<\/strong> The Architect and appointed moderators have final authority on all conduct and post-placement disputes. The Company reserves the right to issue a warning or proceed directly to permanent termination (&#8220;Dishonorable Discharge&#8221;) depending on the severity of the breach. Grievances regarding moderation must be handled privately with The Architect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.4 Effect of Termination.<\/strong> Upon termination for Conduct Unbecoming:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Access to the Battalion Hub, Training Vault, and all digital assets is revoked immediately.<\/li>\n\n\n\n<li>The Member is removed from all assigned Squads and private forums.<\/li>\n\n\n\n<li>No refunds, pro-rated or otherwise, will be issued; all remaining time on a term or subscription is forfeited.<\/li>\n\n\n\n<li>The Member remains bound by the IP Fortress (Section 3) and the Covenant of Silence (Section 4) in perpetuity.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>SECTION 7: JURISDICTION &amp; GENERAL PROVISIONS<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.1 Governing Law and Jurisdiction.<\/strong> This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Hampden County, Massachusetts, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.2 Entire Agreement.<\/strong> This Agreement, including the Articles of Engagement and the specific terms of the Member\u2019s Rank, constitutes the entire agreement between the Member and The Company regarding the Academy and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.3 Severability.<\/strong> If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.4 Non-Waiver.<\/strong> The failure of The Company to enforce any part of this Agreement shall not constitute a waiver of The Company\u2019s right to later enforce that or any other part of this Agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.5 Modifications.<\/strong> The Company reserves the right to update these terms at any time. Continued use of the Battalion Hub after such changes constitutes acceptance of the new terms.
